ARTICLE 2: SUBJECT OF THE AGREEMENT

The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and digital delivery of Digital Educational Content, Membership Packages, or Live Training Services ("Service"), ordered electronically by the BUYER via the www.yosomind.com website, in accordance with the laws of the United States of America, without prejudice to mandatory local consumer protection regulations where applicable.

ARTICLE 4: MEMBERSHIP TYPES AND ACADEMY PROVISIONS 

4.1. Service Categories: The services provided under this agreement are divided into two main categories:

• a) YosoFlex (Standard Membership): Grants access to pre-recorded fundamental video content.

• b) Yosomind Academy (Instructor Membership): Includes specialized training, live streams, supervision, and certification processes in addition to standard content. 

• 4.2. Access Duration & Termination: Yosomind Academy services are "Subscription-Based." The BUYER may access the education panel as long as the subscription fee is paid. The BUYER may cancel the membership at any time; in such cases, the right of access shall continue until the end of the current billing cycle. Upon the expiration of the billing period, the BUYER's access to the entire panel, including previously completed training modules, shall terminate.

• 4.3. Certification: Yosomind Academy membership does not guarantee certification. To qualify for a certificate, the BUYER must successfully fulfill the specific attendance requirements, assignment submissions, and assessment criteria explicitly outlined for each individual training program and approved by the Master Trainers (Elif Gökçe & Fatma Nur Bilgin). Certificates issued are "Yosomind Academy Approved" and do not guarantee direct equivalency with third-party institutions.

ARTICLE 5: DELIVERY (DIGITAL ACCESS) 

5.1. The Service subject to this agreement is an intangible good and a digital service performed immediately. No physical product will be shipped. 

5.2. Upon successful payment, the BUYER’s account is automatically activated, and the Service is deemed fully performed. 

5.3. The BUYER is responsible for the accuracy of the email address provided during registration. The SELLER is not liable for non-delivery of access credentials due to incorrect information provided by the BUYER.

ARTICLE 6: RIGHT OF WITHDRAWAL AND REFUND POLICY 

6.1. The Services subject to this agreement (Video recordings, PDF documents, and Live Training Streams) fall under the category of "Services performed instantly in an electronic environment or intangible goods delivered immediately to the consumer." 

6.2. The BUYER explicitly acknowledges and accepts that, upon confirming the purchase and gaining access to the system, there is NO RIGHT OF WITHDRAWAL and NO REFUNDS shall be issued.

ARTICLE 7: INTELLECTUAL PROPERTY AND COPYRIGHT 

7.1. All videos, audio files, written materials (PDFs), logos, and educational methodologies on the platform are the exclusive property of Yosomind LLC. 

7.2. The BUYER is granted a limited, non-transferable license to use these materials solely for individual educational purposes. Copying, recording, reproducing, sharing with third parties, or using these materials for any commercial activity (such as teaching elsewhere without authorization) is strictly prohibited. 

7.3. In the event of a violation, the SELLER reserves the right to terminate the BUYER’s membership without compensation and initiate legal proceedings under US Intellectual Property Laws.

ARTICLE 8: PRIVACY AND CONSENT TO RECORDING (FOR ACADEMY) 

8.1. Live sessions (Zoom, etc.) within Yosomind Academy are recorded for archival and educational quality purposes. 

8.2. By participating in live sessions with their camera on, the BUYER expressly consents to their image and voice being recorded and made available to other students on Yosomind Academy’s closed-circuit educational platform.

ARTICLE 9: HEALTH DISCLAIMER

Yosomind Academy trainings do not constitute medical advice, diagnosis, or treatment. The BUYER is solely responsible for any physical or emotional discomfort that may arise during somatic work and physical exercises. The BUYER declares that their health condition is suitable for these activities.

ARTICLE 10: GOVERNING LAW AND JURISDICTION

This agreement shall be governed by and construed in accordance with the Laws of the United States of America (State of Wyoming). Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the Courts of the United States.

ARTICLE 11: ENFORCEMENT

By completing the payment on the website, the BUYER is deemed to have read, understood, and accepted all articles of this agreement.
